Terms of Service

1. Acceptance of Terms

By accessing and using Nimbus ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Nimbus provides an AI-powered platform for software development, including but not limited to MVP generation, task-based development, and code generation services. The Service is provided "as is" and "as available" without any warranties.

2.1 How the Service is delivered

• Entirely online, through this website. Nothing is shipped or installed, and no physical goods are supplied.
• You describe what you need in your own words and connect a code repository you control.
• We generate the code and deliver it into that repository as a branch and a pull request, with a preview deployment you can open.
• Further work is requested as tasks in your dashboard; each task is delivered the same way, as changes you review before merging.
• The output is code in your own repository. We do not host your production application, and deploying it remains yours to do.
• Work is paid for in credits. Credits are purchased up front, never expire, and are taken from your wallet when a piece of work starts — see Payment Policy §9, which sets out exactly when, and when they are returned.

3. Eligibility

Nimbus is available both to individuals acting for themselves and to businesses. You may open an account as a private individual (a consumer), or on behalf of a company, agency or other organisation. If you use Nimbus on behalf of a business, you confirm that you are authorised to accept these terms for it, and that business is the customer. Where local consumer law gives an individual rights that these terms cannot limit, those rights stand.

You must be at least 18 years of age, or the age of legal majority in your jurisdiction if that is older, to create an account or use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement with us. We do not knowingly permit anyone under this age to register for an account; see Section 9 (Children's Privacy) of our Privacy Policy for how we handle information relating to minors.

Nimbus is not available to anyone in, or ordinarily resident in, Russia, Belarus, Iran, North Korea, Syria or Cuba. We block access from these countries by IP address, refuse sign-ups from email addresses on their national domains or on major Russian and Belarusian free-mail services, and do not accept payments with a billing address in or pay out to a bank account in any of them.

4. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

5. Credits and Payment

Our Service operates on a credit-based system:

• Prices are displayed in your selected currency (EUR, USD, SAR, MAD, CAD, LKR, AZN, KZT, CLP, ZAR, BRL, ARS, KGS, AED, MYR, INR, QAR, OMR, JOD, or KWD)
• Exchange rates are updated automatically and may fluctuate
• Credits are purchased packages and do not expire
• Credits are non-refundable except as required by law or as specified in our refund policy
• Pricing is subject to change with 30 days notice
• All payments are processed securely through our payment provider

6. Acceptable Use

You agree not to use the Service to:

• Violate any laws or regulations
• Generate malicious code or content
• Infringe on intellectual property rights
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for competitive purposes

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Nimbus and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Code generated through the Service is owned by you, subject to our license terms for the underlying AI technology.

8. Limitation of Liability

To the maximum extent permitted by law, Nimbus shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

9. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by United Kingdom law. Any disputes will be resolved in the courts of England and Wales.

This agreement is provided in English. In case of translation discrepancies, the English version prevails.
